England star Ashley Cole is suing the News of the World and the Sun over a series of stories about gay footballers, it was reported today.

Cole has filed writs against News Group Newspapers, owner of the News of the World and the Sun, according to trade magazine Press Gazette, which cited information from a gay website, Pinknews.co.uk.

 

The Arsenal defender is said to be suing for harassment, libel and breach of privacy, even though he was not named in the News of the World story, published on February 12, which alleged two unnamed Premiership footballers and a music DJ engaged in a "homosexual orgy".

 

The tabloid promoted the story with TV advertising but the article said it could not name the footballers due to legal reasons.

 

After the story, headlined "Gay as you go", alleged that "two bisexual stars made some very dirty phone calls - using a mobile as a gay sex toy", bloggers and websites claimed Cole was one of the players involved.

 

"The three men - who cannot be identified for legal reasons - are pictured wearing just vests and boxer shorts as they tackle each other in ways fans never expected," the newspaper reported.

 

The News of the World said its reporter had seen the images, but did not claim that the mobile phone footage of the "orgy" was in the newspaper's possession, which could have legal implications.

 

Pinknews.co.uk compared the obscured photograph of two men the News of the World published with a photograph of a DJ and Cole from the Choice FM website. In the News of the World picture the two men had lighter skin and a large watch was removed, but the website superimposed the two photographs, showing the silhouette of the two men was the same in both.

 

When the Sun, which published follow-up stories about the unnamed players, ran a story about Ashley Cole on February 16, it prompted his solicitors to write to newspaper editors.

 

Cole's lawyers complained that the photograph and accompanying text suggested he was one of the players involved in the News of the World story.

 

They said their client denied he has been involved in a sexual relationship with another Premiership footballer or with any other man.

 

News International and Cole's lawyers both declined to comment.
