Because Carlos Tevez never was ineligible. The Premier League did not have a problem with the Argentina striker?s registration ? they had a problem with the third-party agreement between West Ham and Kia Joorabchian?s company, MSI. What is the agreement? Effectively, it means Tevez signed away his rights and put his destiny in the hands of Joorabchian, who contracted him to West Ham. It allows Joorabchian to dictate when Tevez is transferred but the Premier League say leaving West Ham should be up to the player. What if Joorabchian wants to move Tevez to another club? That?s another problem. West Ham may not wish to transfer him. The Premier League argued that the agreement is a restraint of trade. Joorabchian maintains that his contract with West Ham is valid, but the Premier League?s Independent Commission say it is unenforceable in law and set it aside. They have given a copy of the report to Joorabchian?s lawyers. So if the agreement was invalid, why were West Ham fined £5.5million? They admitted breaching rules B13 and U18. As well as being fined, they were given two options: renegotiate the agreement to satisfy the Premier League ? as Liverpool did when they signed Javier Mascherano, who arrived at West Ham under a similar agreement with Joorabchian; or tear up the agreement so that they could continue to play Tevez. So what did they do? They tore up the third-party agreement so that Tevez could play against Wigan. And then what happened? Tevez was man of the match in their 3-0 win. No, not that. Why are people saying Tevez will not play against Bolton on Saturday? It can be argued ? and probably will be ? that if West Ham no longer have a contract with the man who owns Tevez?s contract, they have no right to play him. So will Tevez play against Bolton? Yes, unless he pulls a hamstring during a conversation with Joorabchian on Friday night. What happens next? West Ham want to renegotiate the Tevez deal at the end of the season, which, in their eyes, means he can play in their final two games against Bolton and Manchester United. Joorabchian wants to renegotiate it now. So there?s more to come?It?s not over till the fat lady sings, so watch this space. source Bottom line seems to be that Tevez is not a WHU player, could this be an opportunity for us to get this player much as we did with Masherano ?

Magic8Ball Posted May 4, 2007 Author Posted May 4, 2007 What we've failed to do this season is break down teams that want to defend against ussome say a world class striker is the answer, but I think its more basic than that. What we have are a number of good passers of the ball, Alonso, Gerrard and Masherano can hit one of our players with a pass of over 20 yards no problem, but this sort of passing is only really beneficial in an open game. Of the 3 midfielders only Gerrard can actually run the ball at the opposition committing defenders and forcing them to make mistakesyet despite this ability Gerrard is not a ball carrier. In short we have no ball carriers in the team other than Pennant who is regularly double teamed, some say we are missing Kewell ( could be true) but what's for sure is we miss the ability to run the ball and create a moment of unexpected magic that sort of ability with our natural passing game would mean a lot more chances for our strikers and our midfield, ie a sharing of the goal scoring through out the team I see Tevez as the sort of player who would allow Kuyt to play further forward and thus be in a goal scoring position more often, Tevez would be a great option to allow us to change our game when things are not going for us, and I expect that Tevez would be able to hold onto the ball better than Garcia In short I feel a player like Tevez would allow us to score more goals and the goal scoring would be better spread around the team, this I believe is something Rafa would prefer over the option of a single goal scorer

We need a goalscorer. Tevez (good player though he is) would be another bits and pieces scorer who might get 10 a season at a push. We have plenty of those. Look back through the Premiership and the team that wins the league nearly always has a 20+ goals a season man. Tevez is a good player but not what we need IMO. Wouldn't be against him coming here but he's not a priority IMO.

I dont think Rafa would want to cancel it. Im sure he knew when he signed him that investment was coming in along wiht the extra tv money etc yet he still picked him up. I have never seen him play so cant judge, but Rafa must like him.
Leo No.8 Posted May 4, 2007 Posted May 4, 2007 (edited) Skilful player in the final third who is fast as f*ck and runs past defenders. I'm not sure how anyone can argue that's not exactly what we lack at the moment. We're strong with great depth defensively, have probably the best central midfield quartet in world football, but we've basically got one established player who can run with the ball past defenders (Gerrard), one who is starting to do it (Pennant) and that's it. We need a forward who can do this (Tevez fits the bill nicely) as the current lot all have excellent attributes but none could be called ball carriers, and at least one attacking midfielder who can too, possibly two. That's all we need this summer, it really is all we lack. Edited May 4, 2007 by Leo No.8

Argentine striker Tevez is going to move on, with his agents and 'owners' fuming about the way they have been carved out of the controversial deal that has put Hammers in the dock. Wannabe Hammers owner Kia Joorabchian - the man who brought Tevez and Javier Mascherano in on a double deal - met Kop chief Rafa Benitez in a London hotel before yesterday's game at Fulham. Benitez already has taken Mascherano on loan with a view to a full-time buy and now his pal Tevez is being lined up to join him for next season too. Top insiders reveal that Tevez now will be found a new home in the Premiership and that is sure to spark further anger about who controls the South American star. Hammers were fined £5.5million for misleading the Premier League about third-party ownership of Tevez by Joorabchian - and they were advised to rip up the contract with him. But the reaction from Tevez's camp is to move the striker on as soon as possible - and that will only add fuel to the fire about who profits from his moves. I understand that Tevez's advisors already have been in Brazil to thrash out their slice of the transfer with Corinthians, the club he was signed from last August. The plan is for Tevez's next club - with possibly Manchester United and Chelsea also keen - to pay £12m to Corinthians, who will then pay back the money owed to Joorabchian and his sidekicks.
