Players Buying Themselves Out Of Contracts

Heinze may exploit new ruling to buy his way out

Defender able to invoke Fifa clause

Other players could follow suit

Gabriel Heinze, the Manchester United defender, could become one of the first Barclays Premiership players to ?buy out? his contract by invoking a little-known clause in Fifa?s new transfer regulations.

Under the legislation, the Argentina defender will be entitled to serve 15 days? notice on his contract in June and to join any one of his suitors in France, Italy or Spain, with United receiving a compensation fee of about £6 million.

Numerous leading players could be in a position to exploit the ruling in the summer, such as John Terry, Ricardo Carvalho and Frank Lampard at Chelsea, Xabi Alonso and Luis García at Liverpool and Gilberto Silva at Arsenal. But, while all of those are likely to be offered new contracts in the coming months, Heinze, frustrated by his lack of first-team opportunities this season, is understood to be giving serious thought to serving notice on his contract unless the club agree to sell him.

Under Fifa regulations, a contract ceases to be ?protected? after a period of three years if the player was under 28 when he signed. At that point he or, more realistically, another club may ?buy out? the contract at 15 days? notice, provided that a compensation fee is paid to the club owning his registration.

The only precedent involves Andy Webster, the Scotland defender, who was given permission by Fifa to leave Heart of Midlothian to join Wigan Athletic in September. His transfer fee has yet to be set by a Fifa tribunal, but Hearts, who valued him at £2 million, are expected to receive a far smaller sum, which is likely to equate to the estimated £250,000 he would have earned in the final year of his contract at Tynecastle. In Heinze?s case, with two years remaining on his contract, the fee would be closer to £6 million.

Heinze, 28, has struggled to regain his first-team place from Patrice Evra since returning from a knee-ligament injury and is also aware of Sir Alex Ferguson?s interest in Gareth Bale, the 17-year-old Southampton left back. With Juventus and Paris Saint-Germain having confirmed their interest in his services, Heinze has indicated that he will review his options in the summer.

?I know there is interest from AC Milan for me, but now the decision remains with Manchester United,? Heinze said. ?I have a contract signed until June 2007 and I do not want to go anywhere in January. I want to wait until June to see what happens. I have a lot of other options in European clubs for the next season.?

Those remarks baffled Ferguson, who confessed to have ?dived for my file? upon reading that the player?s contract expires in June. ?I was sure that wasn?t right,? the United manager said. ?We don?t let these things happen. It?s 2009 (that his contract expires).?

Although the contract has more than two years to run, it will cease to be ?protected? in June, the third anniversary of his arrival from PSG. Unless Heinze signs a new deal before June, which is unlikely, he is expected to pursue a move.

Another United player attracting covetous glances is Giuseppe Rossi, the Italy Under-21 forward, who rejoined Parma on loan last week. The 19-year-old is highly regarded by United, but his agent, Andrea Pastorello, has cited interest from Barcelona, Milan, Inter Milan, Juventus and AS Roma.

Rafael Benítez, the Liverpool manager, has signalled his willingness to discuss new contracts with Alonso and García, who are approaching the end of the ?protected? periods of their contracts at Anfield. Both could leave for fees in the region of £6 million in August, but the Merseyside club are planning to open talks with their representatives imminently.

I think it's if the contract is signed when you're under 28, you can buy it out 2 years in advance, over 28 and it's only a year.

Again, Football Manager leads the way with football education.

Looks like Xabi and Luis (along with Reina) will be getting new deals soonish

Spaniards set for new contract talks, Jan 24 2007 by Ian Doyle, Liverpool Daily Post

LIVERPOOL are ready to sit down and discuss new contracts with Xabi Alonso and Luis Garcia.

Rafael Benitez is keen to extend the Anfield careers of the Spanish duo, who have proven a huge success in England since arriving before deadline day in August 2004.

Alonso, signed for £10.6million from Real Sociedad, is under contract until the summer of 2009, while Garcia, a £6m capture from Barcelona, is poised to become a free agent at the end of next season.

Alonso has long been linked with a move to Real Madrid while Garcia is attracting the interest of former club Atletico Madrid, despite being ruled out for the rest of the season with cruciate ligament damage.

Liverpool, though, want to keep hold of both players and negotiations could even begin later this week, with Benitez having already indicated his desire to reach a new agreement with goalkeeper Pepe Reina to head off interest from Valencia.

Liverpool have also made the move in light of new rules over contracts that are due to come into force in August.

Referred to as the ?protected period?, if a player?s contract was signed prior to reaching the age of 28 then, provided he has completed three entire seasons or three entire years, he is permitted to buy out the remainder of his contract with just 15 days? notice. However, if the contract was signed after he reaches 28, only two seasons or years must be served.

In effect, the buy-out value will become the player?s transfer value as interested clubs would no doubt pay the fee rather than the player himself.

Both Alonso and Garcia fall out of their ?protected period? at the end of the season and could conceivably then buy out their present contracts.

Heinze for 6million would be excellent business. One of the few players at United that I would like to see at our club, He is an excellent player.

Never going to happen, though with the weird and wonderful world of the premiership - anything is possible.

Neither of our players mentioned would do that. Both are of almost legendary status and it would appear that they are enjoying their time in England.

As an aside it will be interesting to see what Xabi's new terms will be. Anyone know his current terms?

I don't think they are on a massive amount as compared, very moderate from heresay. Puzzles me how Kay came to the idea that although Garcia has a year less, and I'm sure earns less than Alonso, how he could go for a similar £6m buy out fee. Either he's wrong, or I'm not understanding these regulations.

interesting. I would think that 6mil is higher than the transfer fee for Heinz anyway. He's injury prone and not played in a while. 4-5mil would cover the fee I am sure.

also, the feature was taken of FM I think....

OK, lets all brace ourselves, yet again, for the Gerrard to..........stories at around this time next year

If Gerrard still hasn't signed a new contract by this time next year then I hope we will have sold him. We don't want another Owen situation on our hands. Gerrard signed a 4 year deal 2 summers ago. That means it's contract renewal time again this summer.

Lets see what happens between now and then. If we are there or thereabouts come the last few games i doubt Gerrard will have any hesitation in signing a new deal. Its clear for everyone to see that we are improving every season and rafa has admitted that the spine of the side is here, he just needs the ribs.
