Moyes slaps writ on RooneyApr 20 2007

EVERTON boss David Moyes today launched legal action against Wayne Rooney over claims in his ex- player?s autobiography.

 

The Blues boss has issued libel proceedings against the England and Manchester United star over allegations in Rooney?s book that Moyes leaked details of private chats between the pair to the ECHO.

 

Moyes has also issued proceedings against the book?s author, sports writer Hunter Davies, and the publisher of My Story So Far, Harper Collins.

 

He is claiming more than £300,000 in damages from his former player and has already paid more than £2,000 in court fees bringing the action.

 

The writ, which has now been received by the High Court of Justice in London, came after Moyes studied passages in the book in which Rooney claimed his then-manager breached his confidence.

 

 

The 21-year-old Croxteth-born striker alleges Moyes leaked details of private conversations to the ECHO, a claim strongly denied by the Everton boss.

 

The writ also claims Moyes has suffered considerable embarrassment to his reputation when it was stated in the book that Rooney called him ?a ****ing joke, whom he couldn?t trust?.

 

Unless the writ is settled by Rooney, Davies and Harper Collins, the High Court will decide on whether Moyes is entitled to damages and the amount.

 

Moyes has also asked for an injunction against Rooney and Davies, banning them from publishing the controversial passage of the book again.

 

 

The writ alleges the defendants (Rooney, Davies and Harper Collins) published the book and the libel:

 

 

Without checking with Moyes or the Liverpool ECHO if it was true. It adds that the ECHO article did not even reflect Rooney?s complaint.

 

 

Failed to mention that Moyes angrily denied the leak during the dressing room row.

 

 

Offered no apology to Moyes despite various letters from his legal team in September 2006.

 

 

A spokesman for Everton FC refused to comment and said: ?This is a private matter involving David Moyes.?

 

 

No-one from Rooney?s representatives or Harper Collins were available to comment.

Couldn't have put it better. It's just a shame that any damages awarded would barely make a scratch on Rooney's finances.
