Anyone know anything on employment law?

To cut along story short.

 

I got TUPE'd from the goverment to a private firm in April. Now they are saying I have to re apply for my job with everyone else that TUPE'd over.

 

9 people 6 jobs.

 

some bloke (agency worker) has worked there 2 weeks (took over from another agency worker) and he can apply for the job I have doen for 8 + years.

 

Surely this can not be legal?
