Without going into too much detail.

 

You have Job A which is a full time management role that you have been employed to do for at least 6 months, you also have confirmation letters etc of you having that position, including salary.

 

You then have Job B which is based in the same office as Job A but is a part time supervisory position. This role has not been active for 10 months due to the person in that role being on maternity leave. She is due to return within a month.

 

Due to a cost saving exercise it is decided, and announced that you'll be getting rid of Job B, as only Job A will exist within the new structure. There is absolutely no change at all to Job A. Job B is essentially redundant.

 

However both candidates currently in the respective roles are invited to apply for Job A despite one person already holding this position.

 

Is this at all legal as Job A is not being made redundant.
