car insurance claims

My daughter scrapped my BILs car, only minutely, but he wants it repairing 'cause of rust etc. He is telling her that he can get the job done for £300.00, her access is £250.00, so said its better for her to pay for it in cash rather than lose her no claims for £50.00, but it's his access surely isn't it? I thought he would have to pay his access and then the rest would come from her insurance.

I have never had to claim, so don't know, so who is right?, me or him?
