Need advice

The problem is related to my wife who has been off work with work related stress and anxiety since August 2004. Her company has an insurance policy in place to protect employees wages (well, 70% of salary) if they are signed off on long term sickness. This has still not been enforced as the insurance company are still (I KNOW!) using delaying tactics.

 

Unfortunately her company seems to be fvcking her about, even to the point where the insurance company have paid an interim payment (with no admission of responsibility) as it has taken them so long for them to sort it out. We know how much they paid her company as we received paperwork noting the amount and period, but her company has held some of that money back.

 

They are saying they will not pay my wife the rest of the money because she is on maternity leave, although the policy (nor the insurance company) have any mention of this being a factor. We received the money up until my wife started her maternity leave, and they have held all the money back after that point, even though the insurance company is well aware of the maternity leave etc. They will no longer talk to her about the problem, saying it is closed and she will have to raise a grievance. This is on top of the fact that she is already going through internal procedures and her grievance (22 issues) was whitewashed (yep, all 22 issues)! The insurance company wont talk to us as the policy is with the employer, not the employee (fair enough I suppose).

 

I have more info but wanted to keep this relatively short to see if there is anybody in a position to give some professional advice or guidance to us upfront.
