So, my daughter did a day's work for my employer (school). She delivered a dance workshop. She's 16.

She entered into a verbal contract to pay her £150 for the day.

Finance are now refusing to pay her citing the following reasons:

  • All self-employed individuals must complete an employment check for Tax/NI purposes 
  • Payment to individuals can only be made if they are registered as self-employed with HMRC

She never got asked if she was self employed before doing the day's work and nor did we get told she had to be.

Finance are pointing the finger at the member of staff who offered her the job and vice versa. Basically passing the buck and in the meantime refusing to pay my fkin daugther.

ACAS have said I've got grounds for a claim for unlawful deduction of wages. I really don't want to go down this route but may have to out of principle (not arsed about the monday I'll pay her that out of my pocket).

Am I in a strong position here?
