We know there is a confidentiality clause in the bidding process, this will be why (hopefully) some bidders are keeping their traps shut and BarCap aren't about to break that.

if it's a metter of public record there is no harm in the lawyer releasing that. If it's true about teh email thread the reply was probably checked with the PR agency anyway.
